Section 80-IAC Tax Exemption for Startups

What is the Section 80-IAC tax exemption?

Section 80-IAC of the Income-tax Act allows eligible startups to deduct 100% of their profits for any three consecutive assessment years out of the first ten years from incorporation. To claim it, a DPIIT-recognised startup must obtain a certificate of eligibility from the Inter-Ministerial Board (IMB).

Eligibility

  • The startup is recognised by DPIIT under Startup India.
  • It is a Private Limited Company or LLP (partnership firms are not eligible for 80-IAC).
  • It was incorporated on or after 1 April 2016 and within the window notified by the government (currently extended to companies incorporated before 1 April 2030).
  • Turnover does not exceed ₹100 crore in the year for which the deduction is claimed.
  • It is engaged in innovation, development or improvement of products, processes or services, or a scalable business model with high potential for employment or wealth creation.

Why professional preparation matters

The IMB looks closely at how innovative your product is, the market potential and your traction. A generic application is often rejected or deferred. We prepare a strong application covering:

  • the problem and your solution, and what makes it new or better than existing options;
  • revenue model, scalability and job creation;
  • financials, funding and milestones; and
  • IP, awards and partnerships that support your claim.

When should you apply?

Apply as early as possible after DPIIT recognition. You can choose any three consecutive profitable years within the first ten years, so having the certificate in hand lets you plan your tax position with confidence.

Yes. Both Private Limited Companies and LLPs recognised by DPIIT can apply. Registered partnership firms are not eligible.

Do I have to choose the 3 years upfront?

No. You can claim the deduction for any three consecutive years out of the first ten years from incorporation, when you are profitable.

Does 80-IAC exempt MAT as well?

No. Companies claiming 80-IAC may still be liable for Minimum Alternate Tax unless they opt for the new tax regime under which MAT does not apply. We help you evaluate this with your CA.
