Trademark Hearing Representation

When is a trademark hearing held?

If the examiner is not satisfied with your reply to the examination report, the registry schedules a show cause hearing. It is your chance to explain, in person or by video, why the mark should be accepted. Missing the hearing without an adjournment can lead to the application being treated as abandoned or refused.

How we prepare for the hearing

  • Review the objection – similarity to earlier marks, descriptiveness or lack of distinctiveness.
  • Written submissions setting out legal arguments and relevant decisions.
  • Evidence of use – sales, advertising and online presence showing your mark has acquired distinctiveness.
  • Search analysis to distinguish the cited marks.

At the hearing

An IP attorney appears for you before the hearing officer, argues the case and answers questions. Where helpful, we offer a limitation of goods or services, or a disclaimer, to overcome the objection. After the hearing the registry issues its order – acceptance and advertisement in the Trade Marks Journal, or refusal with reasons.

After the decision

If the mark is accepted it is advertised for opposition; we watch for any trademark opposition. If it is refused, we explain the review and appeal options. New brand? Start with trademark registration.
